Hospital’s have been required to comply with CMS’s Hospital Price Transparency Rule since January 1, 2021. We estimate 30% of hospitals are actually compliant. Non-compliant hospitals are subject to penalties up to $5,500 per day.

We calculate the HDA compliance score based on the answers to 10 questions in 2 categories, Accessibility/Format and Data Elements, all of which are pulled directly from CMS requirements for machine-readable price transparency files.

Each question is worth one point. Any score less than 10 means a hospital is non-compliant.
